Enduring Power of Attorney


An Enduring Power of Attorney is a legal document where you (the Donor) give another person (the Attorney) authority to look after your financial and/or personal affairs, in the event that you no longer have the decision-making capacity to do so yourself.

You might lose decision-making capacity due to, for example, old age dementia, acquired brain injury, or other illness. These situations can be stressful for family members who want to help manage your affairs. An Enduring Power of Attorney can reduce the stress of your family at an already difficult time, and prevent family disputes, by specifying who you want to make decisions and what type of decisions.

The Assisted Decision-Making (Capacity) Act 2015 has reformed how people set up Enduring Power of Attorney. The Decision Support Service is the regulator in charge of decision-support and Enduring Power of Attorney documents must be registered online with them.

Please note: Before making an Appointment with Shannons for an Enduring Power of Attorney Application you should contact your treating doctor to make sure that he is willing to sign the Mental Capacity Statement for the Donor. If this is not possible then an enduring power of attorney cannot be made.
