Key Points:
The appointment of Executors. There is a minimum requirement of one Executor but it is best to have two Executors. In a married couple with adult children scenario, the spouse and eldest child could be appointed. Ollie explains to clients being an Executor is more of a burden than a privilege so don’t be afraid to leave somebody important in your life out of this role.
The Distribution of the Estate. Generally, a husband and wife would leave everything to one another and in the event of their death it would be left to the children in equal shares. Obviously, every family dynamic is different and we can listen and advise once we have full instructions from you.
Inheritance / Gift Tax. Shannons can give general advice on this matter and we also have Tax experts to hand to advise fully if required.
Benefits of making a Will. You can set out your wishes as to the distribution of your estate. You can ensure your wife/husband gets everything and then in turn your children. You can ensure specific items are left to individuals. You can choose the person to look after your affairs in appointing the Executor. You can reduce the inheritance tax with estate planning.
Probate
When a loved one dies, the Estate may need to be administered to account for all monies due to the Estate and property may need to be transferred to the beneficial owner(s).
The Executor and family members can arrange a consultation with Ollie and he can determine the next steps whether there is a requirement for extracting a Grant of Probate or whether the original death certificate will be sufficient to release money or remove a party from the title of the property.
A simple tip between spouses would be to have everything in joint names like the family home, bank accounts and credit union accounts as this will then fall outside of the Estate.
